Gibson Attempts To Stop Activision From Selling Guitar Hero

Nashville based guitar maker Gibson, has filed a lawsuit in which they claim patent infringement by Activision for their Guitar Hero franchise. Gibson’s 1999 patent covers a virtual reality device that included a headset with speakers and that simulated participating in a concert.

The patent also describes being able to ’simulate participation in a concert by playing musical instrument and wearing a head-mounted 3-D display that includes stereo speakers’ and well as ‘playback of audio and video of a prerecorded concert and a separate track of audio from the user’s instrument.’

Gibson is trying to get a court order to stop Guitar Hero, in all its forms, from being sold until Activision retains a license to use that technology. Activision is essentially saying f*^K off and asking the courts to declare that GH does not violate any patents of Gibson.

Here’s the thing; nothing is going to stop Activision from selling Guitar Hero. Sorry Gibson, you might as well take the inevitable small monetary pay off to drop the suite and shut up. The game is a high powered locomotive of cash and your johnny-come-lately court dealings aren’t going to slow it down.
